Our CAT Case posted on 03.08.10
Dear friends,
Our case has been posted on 03.08.10 and not 26.07.10,as stated earlier. Any further information will be given in due course.
Dear Permanandji, Our GS Shri Roopchand told in Maharashtra Circle conference at Nagpur on 3.7.2010 that DOP has already sent reply to MOF. He was not aware about the text in reply sent by Dte. You say reply has not been sent.What may be truth?. Only God Knows.
Sir, Basing on CAT positive judgement will it be implemented? or not. Dte. twice sent proposal to MOF for upgradation of GP of IP to 4600 means Dte is positive on it. Only problem lies with MOF.

Not only Assistants in Armed Forces, but all the Assistants were in the Scale of Rs.5500-9000 as on 01.01.2006. Their pay scale was upgraded to Rs.6500-10500 in Sept'2006. This point has already been mentioned in the OA. Thanks. Permanand.
The department has submitted the proposal for upgradation of the GP of IP/ASP/SP two times to MOF. Hence the DOP cannot be file a negative statement against the CAT Case. I would like to know whether you have got the copy of the proposals submitted by the department to MOF and handed over to the advocate for submission to the court? it will definitely help the CAT to take a decision in the matter favourable to us. Please reply
Dear Sir, You are wrong. only Assistants of Central Secretarit got their pay scale upgraded to Rs6500--10500. Assistants of Armed Forces Headquarter,(AFHQ), Office of Joint Secretary and Trg, E Block, DHQ PO, New Delhi were in the pay scale of Rs5500--9000 at that time.AFHQ Assistants went to CAT,Delhi and court directed them to approach 6th CPC. During 6th CPC all the assistants were granted grade pay of Rs4200 (it includes assistants inspectors of centralexice inspector of posts etc) Inspector of Central excise etc and assistants of Central Secretarit Service (CSS) got GP of 4600 vide MOF Order Dt 13-11-09.
But Assistants in AFHQ did not get the GP of 4600, as they were not covered under MOF Order Dt 13-11-09. Then Min of Defence Authorities (Office of JS & Trg) moved the file to Min of Finace, and got orders for sanction of GP of Rs4600 during Feb or March 2010.
The point I would like to mention here is that Assistants in AFHQ were not in the pre revised pay scale of Rs6500--10500, yet they got the grade pay of Rs4600.
Sir, you have mentioned in your blog dated 22-3-2010, that our case will be weak, as in MOF Om F No.1/1/2008 dated 13-11-09, that higher grade pay of Rs4600 is given to those posts which are having pre-revised payscale of Rs6500--10500. But here i have to mention that Assistants of AFHQ wer not in the pre-revised pay scale of Rs6500--10500, they were in the pay scal e of Rs5500--9000 (like that of inspector of posts) yet they got grade pay of 4600. I think if we mention this fact also our case will be strong.

Hi! everybody! Go to DOP&T website and see yesterday's order wherein about 1700 post of UDC (who are equal to PAs & are in the GP of Rs. 2400/-) stands upgraded to the cadre of Assistant (GP Rs. 4600/-) What to talk more ? Holding of various conference ? or filing of cases in various courts ? It's best option to go to Account's line or central sectt. line. May God bless this poor cadre!!
MOF OM dated 16-11-2009 is issued based on OM dated 13-11-2009. Further para 3.1.9 to 3.1.15 of 6cpc recommended CSS Assistants grade pay as Rs. 4200 w.e.f. 1.1.2006 identical to Postal Inspectors. OA 1164 of 2010 (CAT New Delhi) also directed parity of grade pay with Assistants level recently besides OA 164/2009. All these points may be brought to notice of CAT on 3-8-2010
SIR, I Feel we IPOs should get option to work as a BCR so that we can get posting near to Home and we can take care of Family members better way. What non sense it is to work as IP and go every where CAT/Hight courts /Inspections for POs etc etc just like Dogs activity. Since BCR officials are equivalent with IPOs in respect of GP.Hence DOP/Ste should refer the case to DOP&T/MOF for merger of IPOs with BCR so that THE OFFICERS in DTE/ASSOCIATION whose hearts have already burnt to hear the news of chances of 4600 GP to IPOs may get peace and live long. When UDCs /Assistants /Inspectors of other departments can get 4600 GP what crime is done by IPOs in department for not getting 4600 GP. I feel only god/CAT can save IPOs .
Dear Sir, See the OM of DOPT NO.20/29/2006-CSII dated 25-09-06. In this order Assistants of CSS got pay scale of Rs6500--200--10500 w.e.f.15-9-06. Assistants of AFHQ were not included in this order. Now vide Min of Fin Om dt16-11-09, in which it is stated that those posts in the pre-revised scale of Rs6500--10500 were given GP of 4600
In these orders, Assistants of AFHQ, who were not in the pre-revised scale of Rs6500--10500,(They were in pay scale of 5500--9000) were included and they are getting GP of 4600.
In my opinion, if AFHQ Assistants who were in the scle of 5500--9000(Like IPs) can get RS4600 why cant IPs. This should be brought to the notice of the Court. On what ground AFHQ Assistants are getting GP4600.

Dear Anonymous (27th July, 12:10) Thanks for the Comments. We are fighting for the pay parity with the Assistants of CSS. In the MOF OM dated 16.11.09, Grade pay of Rs.4600 was given to Assistants of AFHQ also without mentioning the pre-revised pay scale of Rs.6500-10500. In the OA we have asked parity with Assistants of CSS and Inspectors of CBDT/CBEC. We have to see the reply (yet to be received) of the Dept. of Post / MOF. Depending upon their reply, the issue involving grade pay of Assistants in AFHQ may be raised as they were also having the same pay scale / grade pay till issue of 16.11.09 OM. Thanks. Permanand
Sir, In office memorandum of Min of Fin 1/1/2008-IC, Dept of Expenditure, dt 16-11-09, it is said that they are granting GP Rs4600 to those posts existing in the pre-revised scale of Rs6500--10500 as on 1-1-06. Here assistants of CSS were on Rs6500-10500 as on 1-1-06 and they got GP 4600 and it is correct.
Now Assitants of AFHQ were not in the pay scale of Rs6500--10500.(I am sure about it), they were in pay scale of 5500--9000. How could Min of Finance could grant GP5600 to Assistants of AFHQ. Min of Fiance is playing double standards. Place these facts with orders and discuss with the advocate,and ask him whether he could make something from it.
As on 01.01.2006, Assistants were in the Scale of Rs.5500-9000 and in Sept'2006 only Assistants in CSS were upgraded in the Pay scale of Rs.6500-10500. Separate OM was issued by MOF on 16.11.2009 for the Assistants, as they were not covered under the MOF OM dated 13.11.09, in which Grade pay of Rs.4600 was given for those who were in the pre-revised pay scale of Rs.6500-10500 as on 01.01.2006. OA No.144-A of 1993 and other connected 2 OAs(OA 548/1994 and 985/1993) passed on 19-1-1996 at Principal Bench, New Delhi allowed parity of pay of applicants work in Income Tax, Directorate of Field Publicity and CBI with counterparts of CSS/CSSS in the pre-revised scale of Rs.1640-2900(4cpc). Sir, I once again congrats Permanandji for his careful study in the GP issue.Our association was sleeping when other ministries upgraded their staffs pay scales.Association had other designs in their minds.Why they were mute spectators?
Sir, Kindly see the Kerala Circle Blog and clarification in respect of GP issue of Assitants/PA of Ministry of Petrolium.I am confident the interpretation of Pay commission/MOF should be applicable to IPOs in Department of Posts. But it is sad that nothing is being done by our department. IPOs should have been granted 4600 GP based on the clarification.
please ask Kerala IP & ASP association to move against it iff they have some onus to its member . I am confident ,they will do nothing --they think about their own .

As mentioned earlier the OA No.381/2010 in the Hon'ble CAT Ernakulam Bench is posted for hearing on 03.08.2010. In the meanwhile the CPMG, Kerala Circle has filed the counter on 28.07.2010 on behalf of the Respondents. The Govt. has opposed the OA tooth and nail mentioning that the IPs are not eligible to get GP of Rs.4600/-. All eyes are now on the outcome of the OA in the Hon'ble CAT.
