Progress of CAT Case 381/2010 Filed for Grade pay hike

Dear friends,
    Our CAT case was posted today. No reply has been filed by the respondents on the rejoinder so far. The Tribunal has given two more weeks to the respondents to file the reply to the rejoinder, if any. The case is next posted to 21.10.2010  for final hearing/arguments. As explained by the counsel, the Tribunal takes some time before the final hearing/arguments to study the documents submitted by the applicants as well as  by the respondents. I along with my friends will attend the hearing on 21.10.10. Any further progress in the case will be intimated in due course.

  1. I have seen the rejoinder and I can assure on the basis of rejoinder supllied to me that the case is very much strong. All the issues raised by the Dept. / MOF have been countered strongly and effectively. We have to see, whether any new issues are raised by the Dept./ MOF in the reply to the rejoinder. We may hope for the disposal of the case before Deepawali. This Deepawali may bring some prosperity in the life of IPOs and ASPOs.Thanks to Mr. Permanand for his sincere efforts.

  2. Pressure is mounting on the CHQ leadership of the Association by the continuous effort by the CS Punjab and Orissa Circle. As the CAT Case is also very much strong, Dept. will have to think twice to defend the rejoinder filed in the CAT case 381/10.

    1. You are fighting alone for noble cause wheaeas central leadersship is still undecided even after the mounting pressure from CS punjab and Orrisa Circle.GS has been given enough material for action even the resignation of all members of the Punjab Circle. If he is having courage , he should immediately issue notice to the department for union action and If he is coward then he should submit his resignation as association can not bear such inactive,coward, GS

  6. Getting things replaced generally takes more time and cost compare to the repair. Replacement should be thought of, if found irreparable. We should give chance to our GS to act, otherwise he must be replaced by persons like CS Punjab and Orissa circle. Let us wait for some more time, as ultimatum has already been given by the CS Punjab Circle and he is not alone, we all Inspectors are with him.

  7. Dear Mr.Premanad,
    Please see the copy of upgradation of payscales proposal sent to Ministry of finance (second time)where in note sheet 9/N and 10/N (copy must be availalbe with you now). The department strongly recommeded for upgrdation of payscales explaining their roles and importance and comparing with inspectors of other department. Now department cannot escape its own words. The copy of proposal obtained through RTI may be produced to the court in hearing stage. Which will be very important document where department itself committed for upgradation of payscales in strong words and now it cannot deny that we are not eligible for upgradation.
    This will become very important docuemnt.

  8. Anybody please clarify, if department agrees for 4600 grade pay to inspectors, then the basic pay of IPs at the time of promotion or joining will be 9300 + 4600 or something else.

    Glad that the case has entered the final lap. Whether everything will be finalised on 21.10.10 itself?

    As someone has commented for the previous post, let us not worry about the cadre merger or consequence in establishment due to GP upgradation. It is for the Department to decide on it.

    Hope Association office bearers doesn't chip in, in the last minute with some proposal and claim that it is they who got the GP upgraded.

    As Jayanth has said, if the Dept. itself had strongly supported the upgradation, then it is surprising that they opposed it tooth and nail in the CAT.

    Let us hope for the best and best wishes to you for taking the lead.

    On 21.10.10, argument will start. Normally, in CAT cases, argument takes one or maximum two days. As our case is very much clear, we hope that argument will be completed on 21.10.10 itself. For judgement it may take another 10 days or so. I appreciate the work of Sri Chandrakantha paladhi, who is at Ernakulam and in constant touch with the counsel. After getting the reply from the Respondents on the rejoinder, we will discuss again with the Advocate for the arguments. let us hope for the best.

    The court decisions on parity posted in the www.onlyparity.blogspot.com" are definitely in favour of IPOs GP hike.Please make brief history/summary of all cases posted on the said blog and same may be provided to our advocate so that our case can be full proof in all respets.

    Further our Department may try to twist the case with merger proposal without giving any benifit from 1.1.2006.This is also reflected in the latest proposal submitted by our GS to DG. The GS proposal of GP hike /merger issue is silent about the date. The date of effect is intentionally left to benifit the Department & harm financially to IPOs if the proposal is accepted by DOP.Department is trying to harm IPOs financially.
    There should not be any compromise and IPOs must get GP hike from 1.1.2006 with pay fixation as similar to Inspectors of SBDT etc..

  16. I hope along with the Circle CS Maharashtra CS should also regin from the current post, now a days he is beaving like dictatorship.. still talking against the grade pay hike to IP... i hoe the person who is writing the comments as IP Maharashtra will accept it...

  17. The court case is strong and is in our favour. Thanks to Mr. Parmanand and his team. I think, before go for merger of IP and ASP, we should wait for the outcome/verdict, so that we may think of any other best way for the ASP cadre instead of merger. If IP cadre is ground floor of the building, then ASP cadre is first floor and SP cadre is second floor. Without having strong ground floor, no building can survive. We all (IPs,ASPs & SPs)should work together and co-operate with each other. Senior promotee brothers should take care of their juniors and guide them properly, but in our case many of them always thinks to damage & crush their junior brothers. At the same time, the juniors should respect the senior brothers. God may bless our cadre.

    Do you hope that department will upgrade GP of IP after case has been won by you. Dont hope so. GS and other CS should have actively participate in role otherwise your efforts will be in vain.

    GS should be replaced by person like CS Punjab.

I, hope the comment made my anonymous on September 26, 2010 7:01 AM, may be the current CS of Maharashtra, had anyone seen the current Maharashtra blog, earlier there was a direct link to this site along with Punjab, Andhra, Orissa circle, but he had removed it... because maximum on all this blog, there is lot of discussion of pay hike... which he does not like...

  20. First of all I sincerly convey my thanks to Shri. Premanandji & co for their tireless action to get the grade pay hike to Postal Inspectors and ASPs.
    The present position in our region(Western Region, TN) is that the SP and his Steno are getting the same grade pay of Rs.4800/- and in one Sub Division the IP and her Mail overseer are getting the same Grade pay of Rs.4200/-.( What a pity?)
    Fighting for grade pay hike and acheiving it will only solve the above anomoly and also to retrive the lost glory & respect from our subordinates. Otherwise a day will come that there will not be a single candidate to take up the IP examination in future. Similarly no ASP will join the post of SP(after more than 25 years of servie in IP/ASP cadre) if offered.

  21. yes,since the Deptt.'s Britishers have no concern for this cadre, the day will come, when Postman or Mail Overseer may draw more G.P. then IPs/ASPs. Our promotee officers (PSS Gp B)are equally responsible for this mess. They never co-operated with their younger brothers (ASPs/IPs). I've seen many promotee Indian SSPs/SPs who prefers handshaking with their GDS BPMs then their SDIs/ASPs. U talk of Gazett. status conferred to ASPs - they will oppose, because they wants Disc.power to crush the ASPs/IPs.U talk of merging ASPs with PSS Gp B (like JAOs with AAOs) - they will oppose, because they wants to keep distance and even they may argue that there will be functional disturbances (why there is no funct. disturbs. when AAOs & JAOs merged). Even the GS of Postal Officers Assocn. failed to attend the meeting held at DG office, at the time of discussion/forwarding proposals for upgradation of GP to MOF. Due to co-operations & no infighting, the cadres like Accounts, Central Sectt.s & stenos, really deserves for rewards. Only God may save this cadre.
